Aggressive DUI Defense Representation

Because prosecutors are zealous in their efforts to hold alleged drunk drivers accountable, people who are accused of DUI (driving under the influence) need an equally dedicated defense lawyer on their side.

At the Sloan P. Ellis Law Firm attorney Sloan P. Ellis uses nearly a decade of both defense and prosecutorial experience when protecting our clients' rights in drunk driving cases. From our Greenville office, we represent clients facing DUI charges and other criminal charges throughout the state.

DUI Penalties

In South Carolina, there are a range of penalties for a drunk driving conviction. The ten years prior to the current charge are relevant as a "look-back" period, meaning any DUIs during that time are considered prior offenses for sentencing purposes. Punishments include:

  • First offense:
    • Jail — 48 hours up to 90 days
    • Monetary fines — $400 up to $1,000
    • Six-month driver's license suspension
  • Second offense:
    • Jail — Five days up to three years
    • Monetary fines — $2,100 up to $6,500
    • One-year driver's license suspension
    • Mandatory installation of an ignition interlock device
  • Third offense:
    • Jail — Five days up to three years
    • Monetary fines — $2,100 up to $6,500
    • One-year driver's license suspension
    • Mandatory installation of an ignition interlock device

After the third offense, consequences become even more severe. Also, consequences for refusing a Breathalyzer test range from a six-month license suspension to a one-year suspension, depending on how many times you have previously refused a Breathalyzer.
